Article 1 Memberships

Article 1.1

A membership is an agreement between you and us for participation in our group classes. The selected membership determines the number of group classes you may attend and the membership fee you are required to pay.

Article 1.2

A membership is always entered into for one course year. For the exact dates of the relevant course year, please refer to our website. A membership ends automatically.

Article 1.3

You can register for a membership by completing the registration form. By signing and submitting the registration form, you agree to these terms and conditions.

Article 1.4

Registration should preferably take place before the start of a new course year. After the start of a course year, late registration is possible, subject to availability.

Article 1.5

In addition to memberships, we also offer individual lessons. These terms and conditions also apply to individual lessons.

Article 2 Payment

Article 2.1

By entering into a membership, you agree to pay the membership fee. The fee is due regardless of whether you actually attend classes.

Article 2.2

At registration, you provide us with a direct debit authorisation or you receive a payment request. The membership fee will be collected automatically, either in full or in instalments (up to a maximum of seven instalments).

Article 2.3

If you register during the course year, the fee will be charged pro rata.

Article 2.4

Alternative payment arrangements are only possible after consultation and will always be confirmed by email.

Article 2.5

Individual lessons must be paid immediately after the lesson, either in cash or by card payment.

Article 3 Cancellation of membership

Article 3.1

A membership can only be terminated early at the end of a month, with a minimum notice period of three months.

Article 3.2

Cancellation must be submitted in writing via training@paul-cynthia.nl. Other forms of cancellation will not be processed. We will always confirm a valid cancellation by email.

Article 3.3

A membership may be terminated immediately at the end of the current month in the following cases:

  • Relocation outside our region (proof may be required, such as registration with another municipality);
  • Long-term illness, injury, or pregnancy (medical proof may be required, such as a doctor’s note).

Article 3.4

You have the right to withdraw from the agreement within 14 days from the day the agreement was concluded. The day of conclusion counts as day one. You may exercise this right by sending an email to training@paul-cynthia.nl within the withdrawal period. We will confirm the cancellation. The withdrawal is only final upon confirmation. If any payments have already been made, these will be refunded within 30 days.

Article 4 Scheduling & cancellation

Article 4.1

The schedule for group classes is published on our website. We reserve the right to change the schedule at any time.

Article 4.2

Class allocation is determined at our discretion and may depend on age, progress, and special circumstances. The schedule may change during the course year.

Article 4.3

If a group class cannot take place, we reserve the right to reschedule or adjust the class.

Article 4.4

Registration is always subject to sufficient enrolment. We reserve the right to cancel a class if there are insufficient participants.

Article 4.5

For classes with a maximum number of participants, we determine who may attend.

Article 4.6

We reserve the right to cancel a class due to illness or unavailability of the instructor. We will first attempt to provide a replacement instructor or reschedule. If this is not possible, the class will be cancelled.

Article 4.7

We may cancel a class if fewer than two participants are present.

Article 4.8

In case of cancellation, you will be informed via email or telephone.

Article 4.9

Refunds will only be considered if more than two group classes in a month are cancelled.

Article 4.10

If you are unable to attend, please inform us via training@paul-cynthia.nl. No refund will be given for absence.

Article 4.11

If you cancel a private lesson on the same day or do not show up, the full fee remains payable.

Article 5 Force majeure

Article 5.1

We are not obliged to fulfil our obligations if prevented from doing so due to circumstances beyond our reasonable control.

Article 5.2

During force majeure, we may suspend or adapt services, including:

  • changing location (indoor/outdoor)
  • online or livestream lessons
  • rescheduling lessons within the course year

Article 5.3

If adaptation is not possible, either party may terminate the agreement without liability for damages.

Article 6 Liability

Article 6.1

We accept no liability for material or immaterial damage sustained in the studio or during classes, unless caused by intent or gross negligence.

Article 6.2

You are responsible for your personal belongings at all times. We accept no liability for loss, theft, or damage.

Article 6.3

If you damage our property, you are fully liable for compensation. If multiple persons are involved, liability is joint and several.

Article 7 Personal data

Article 7.1

We process personal data provided by you to provide services, manage your membership, communicate, and process payments.

Article 7.2

We comply with the General Data Protection Regulation (GDPR). Details are available on our website.

Article 7.3

Photos and video recordings may be made during classes for promotional purposes (website, flyers, posters, media). If you object, you may notify us via email. Otherwise, consent is assumed. You may also indicate in person that you do not wish to be photographed or filmed.

Article 8 House rules

Article 8.1

You must comply with our house rules and staff instructions. Failure to do so may result in denial of access and termination of your membership.

Article 8.2

Non-members are not allowed to attend group classes.

Article 8.3

You are responsible for keeping your contact details up to date. Any costs resulting from failure to do so will be at your expense.

Article 9 Final provisions

Article 9.1

Previous versions of these terms and conditions expire upon publication of this version. By registering, you agree to these terms and house rules.

Article 9.2

Dutch law applies exclusively to these terms, memberships, and all related agreements.

Article 9.3

We reserve the right to amend these terms and house rules unilaterally. Updates will be communicated via our website.
